THE HIMACHAL PRADESH VALUE ADDED TAX ACT, 2005. Notifications

Whereas the draft amendment in Part-II of Schedule-A appended to the Himachal Pradesh Value Added Tax Act, 2005 (Act No. 12 of 2005) was issued by the Government vide notification No. EXN-F(10)-1/2006-I, dated 14th May 2009 published in Rajpatra, Himachal Pradesh (Extra-ordinary) on 16th May 2009 in pursuance of the provisions of section 10 of the aforesaid Act for inviting objections and suggestions from the person(s) likely to be affected thereby.

And whereas some objections/suggestions have been received in respect of "Unbranded washing soap" within stipulated period which are being examined separately.

Now, therefore in exercise of the powers conferred by section 10 of the Himachal Pradesh Value Added Tax Act, 2005 (Act No. 12 of 2005), the Governor, Himachal Pradesh is pleased to make the following amendment in Part-II of Schedule-A appended to the aforesaid Act (hereinafter called the said Schedule) namely:-

AMENDMENTS

In PART-II of the Schedule 'A' appended to the Himachal Pradesh Value Added Tax Act, 2005 (Act No. 12 of 2005),..

(i) after existing items No. 23, 28 and 75 the following items 23-A, 28-A and, 75-A respectively shall be inserted, namely:-

"23-A Compressed Fluorescent Light."

"28-A Desi Ghee."

"75-A Pre-engineered steel building and steel components thereof including Puff panels."

(ii) for the existing item No. 85, the following shall be substituted, namely:-

"85 Sales of goods (other then those goods specified in Schedule 'D') made to Government of Himachal Pradesh, subject to furnishing of the certificate in form 'D' appended at the end of this Part." and

(iii) after existing Note, the following certificate in form 'D' shall be inserted, namely:-

"Certificate in Form 'D' "

(To be used when making purchases by the Government of Himachal Pradesh not being a registered dealer).
