THE MADHYA PRADESH VAT (AMENDMENT) ORDINANCE, 2021

[First published in the "Madhya Pradesh Gazette (Extra-ordinary)", dated the 12th January, 2021.]

Promulgated by the Governor in the seventy first year of the Republic of India.

An Ordinance further to amend the Madhya Pradesh Vat Act, 2002.

Whereas, the State Legislature is not in session and the Governor of Madhya Pradesh is satisfied that circumstances exist which render it necessary to take immediate action;

Now, therefore, in exercise of the powers conferred by clause (1) of Article 213 of the Constitution of India, the Governor of Madhya Pradesh is pleased to promulgate the following Ordinance:-

1. Short title and commencement.

(1) This Ordinance may be called the Madhya Pradesh Vat (Amendment) Ordinance, 2021

(2) It shall come into force from the date of its publication in the Madhya Pradesh Gazette.

2. Madhya Pradesh Act No. 20 of 2002 to be temporarily amended.

During the period of operation of this Ordinance, the Madhya Pradesh Vat Act, 2002 (No. 20 of 2002) (hereinafter referred to as the principal Act), Shall have effect subject to the amendment specified in section 3.

3. Amendment of Section 4

In sub-section (8) of section 4 of the principal Act, for the words and full stop "who has been a member of the Madhya Pradesh State Taxation Service and has held the post of Additional Commissioner or equivalent or a higher post for at least three yesrs.", the words and full stop "who has been a member of the Madhya Pradesh State Taxation Service for not less than thirty years and,-

    (a) has held the post of Director or Additional Commissioner; or

    (b) has held the post of Deputy Coomissioner for at least three years.",

shall be substituted.
